1.2 Intellectual Property

Upon full payment, the client receives ownership of the custom code and deliverables produced specifically for their project. Pre-existing frameworks, libraries, and tools used under open-source or commercial licenses remain subject to their respective license terms. SiberFX reserves the right to reuse general-purpose code patterns, techniques, and non-client-specific components across projects.

1.3 Client Responsibilities

  • Provide timely access to necessary materials, content, and feedback.
  • Ensure accurate and complete project requirements are communicated.
  • Adhere to the agreed payment schedule as outlined in the project proposal.
  • Review and approve deliverables within the agreed timeframe.

1.4 Limitation of Liability

SiberFX shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability is limited to the fees paid by the client for the specific project in question. We are not responsible for third-party service outages, including hosting providers, domain registrars, or payment gateways.

1.5 Termination

Either party may terminate an engagement with 30 days written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Any work-in-progress materials will be delivered to the client upon settlement of outstanding invoices.

2. Privacy Policy

SiberFX is committed to protecting the privacy of our clients, website visitors, and users. This policy outlines how we collect, use, store, and protect your personal information in accordance with applicable data protection regulations including GDPR and KVKK.

2.1 Information We Collect

Project-related data is retained for the duration of the business relationship plus any applicable statutory retention period. 4.2 Client Deliverables

Intellectual property rights for custom deliverables transfer to the client upon full payment as specified in the project agreement. SiberFX retains the right to showcase completed projects in our portfolio unless a non-disclosure agreement (NDA) states otherwise.

4.3 Open Source

Some of our projects may incorporate open-source software components. These components are subject to their respective open-source licenses. We make best efforts to document all open-source dependencies and their license terms in the project documentation provided to clients.

4.4 Reporting Infringement

All project quotes provided by SiberFX are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on the requirements provided at the time of estimation. Significant scope changes may require a revised quote.

6.2 Payment Terms

Payment terms are defined in each project proposal or statement of work. Typically, projects require a deposit before work begins, with remaining payments tied to milestones or monthly invoicing. Invoices are due within 14 days of issue unless otherwise agreed.

6.3 Late Payments

Overdue invoices may incur a late fee as specified in the project agreement. SiberFX reserves the right to suspend work on active projects if invoices remain unpaid beyond 30 days. We will always attempt to resolve payment issues through direct communication before taking any action.

6.4 Refund Policy

  • Deposits are non-refundable once work has commenced.
  • Completed milestones are billed and non-refundable.
  • Unused prepaid hours or credits may be refunded on a case-by-case basis.
  • Disputes should be raised within 7 days of invoice receipt.
